1. Who I am
The Movement App ("the app") is provided by Dominik Koch, entrepreneur individuel (régime micro-entrepreneur), 148 Chemin Petit Frère, 97432 St Pierre, La Réunion, France, SIRET 983 102 781 00017, email dominik@decrypt-bodywork.com ("I", "Dominik").
2. What these terms cover
These terms govern your use of the app. Sessions and related services, including prices, payment, cancellation and rescheduling, are governed by my separate terms of sale. Online courses, when available, will have their own terms of sale.
You accept these terms by ticking the box at your first sign-in. The date and the version you accepted are stored.
3. What the app is, and what it is not
- The app supports movement and biomechanics education: exploring, learning and practising movement with my guidance.
- It is not medical care, physiotherapy, diagnosis or treatment, and it is not a substitute for medical care. I do not diagnose conditions or provide medical advice.
- The content is intended to support exploration and education. You decide how you participate and whether an activity is appropriate for you.
- If you have a health condition, pain or an injury, are pregnant, or are unsure whether any of the content suits you, ask your doctor or health professional before practising.
4. Practising safely
- Practise at your own pace, within a range that feels comfortable, and in a safe environment.
- Stop an activity if it causes pain, dizziness, shortness of breath or other concerning symptoms, and seek appropriate medical advice where needed.
- The content in the app is selected for you or for a general audience. You decide how much and whether to practise.
- Please tell me about information that may be relevant to your practice, so that I can take it into account when giving feedback.
5. Your account
- Accounts are personal and invite-only. I create your account and give you access to the app. You sign in with a one-time code sent to your email address. Keep access to your email account secure.
- You must be 18 or older.
- Tell me straight away if you think someone else has accessed your account.
6. What you share
- You can share journal notes, questions, and videos and photos for feedback. Sharing videos and photos requires your separate explicit consent.
- Only share content of yourself. Do not upload videos or photos showing other people without their permission, nothing unlawful, offensive or unrelated to your practice, and no medical documents or medical records.
- You keep the rights to content you upload. You allow me to store, view and annotate it (for example draw on a photo or record a feedback video over a video) for the purpose of giving you movement and biomechanics feedback. Your videos and photos and my feedback on them are not published or used for any other purpose without asking you first, in writing.
- Your videos and photos, together with my feedback videos and the photos I drew on, are deleted automatically 6 months after your last session with me. You can withdraw your consent at any time in Profile & settings; withdrawing it deletes them immediately.
- You can remove an upload before saving it, or ask me to delete any of your videos or photos at any time.
7. My content
The programmes, exercise videos, texts, feedback videos and the app itself are my intellectual property (or used with permission). They are for your personal use while you have access to the app. Please don't copy, share, publish or resell them.
8. Feedback and replies
- I usually reply to questions, videos and photos within 2–3 days, not at weekends. Replies may take longer during holidays; the app shows a notice when I'm away.
- The number of videos and photos you can send may depend on your service or plan. Any limit is shown to you in the app.
9. Sessions
I book your sessions. You receive a calendar invitation by email from Google with a link to the video call (Google Meet), and the app shows your sessions with a "Join" button. Changes and cancellations also arrive as calendar emails.
You can cancel or move a session in the app ("Can't make it? Cancel or move"), with a message about times that suit you; I then get back to you with a new time. The cancellation and rescheduling conditions, including the 24-hour notice period and any charge, are set out in my terms of sale.
10. Availability
I do my best to keep the app available and secure, but I can't guarantee it will be free of interruptions or errors. I may update, change or pause features, for example for maintenance.
11. After our sessions end, and ending your use of the app
- Your account, programme, practice log, journal and messages stay available after our sessions end, so you can keep practising on your own.
- 6 months after your last session with me, new video and photo uploads are switched off and your existing videos and photos (with my feedback on them) are deleted. If you'd like to pick things back up, get in touch through the app.
- 12 months after your last session with me, access to the general exercise library ends. Your own programme stays available.
- These limits are lifted again when we book a new session.
- If you haven't used the app for 12 months, I send you a warning email. If you don't use it within the following 30 days, your account and its content are deleted.
- You can stop using the app at any time and delete your account yourself in Profile & settings (or ask me by email). Deletion is immediate and can't be undone.
- I may suspend or close an account in case of a serious breach of these terms, after telling you why (except in urgent cases, for example misuse endangering others).
12. Liability
I am responsible for providing the app with reasonable care, as required by law. I am not responsible for damage caused by circumstances outside my control (for example a failure of your internet connection or device), or by use of the app contrary to these terms. Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, or limits any mandatory rights you have as a consumer.
13. Personal data
How I process your personal data is explained in my Privacy Policy.
14. Changes to these terms
These terms may be updated (for example when features change). You will be told in the app before important changes apply; if you don't agree, you can stop using the app and delete your account.
15. Law, disputes and mediation
- These terms are governed by French law. If you live in another country, you keep the protection of the mandatory consumer rules of your country (Rome I Regulation, art. 6).
- If you have a complaint, please contact me first: dominik@decrypt-bodywork.com. I'll try to find a solution with you.
- If the complaint isn't resolved, you may, free of charge, refer the dispute to a consumer mediator (Code de la consommation, art. L.612-1).
